The Karnataka High Court has dismissed the petitions of Amazon and Flipkart in the case against the Competition Commission of India (CCI) probe. The petition sought quashing of the previous judgment in which the High Court had dismissed the written petition against the CCI probe. The hearing of the case took place on Friday.
A bench of Justices Satish Chandra Sharma and Nataraj Rangaswamy observed that if the appellant has not contravened any of the provisions of the 2002 Act, they should not hesitate to face the CCI inquiry. Let us inform that both the companies are accused of anti-competitive behaviour, which is being investigated by the Competition Commission of India.
The Confederation of All India Traders (CAIT) and Delhi Trade Federation (DVM) had accused Amazon India and Flipkart of giving more discounts to customers and benefitting some sellers. It was only after these allegations that the CCI ordered an investigation into Amazon and Flipkart in January 2020. It said that there is prima facie all evidence to warrant investigation under section 26(1) of the Competition Act, 2002.
According to the information, Flipkart has filed an appeal late on Wednesday evening. At the same time, Amazon India has filed an appeal on Thursday morning. Both these appeals are likely to come up for hearing on Friday. Both the companies have filed separate appeals. The court can hear both the appeals together. However, no decision has been taken to combine the two appeals. A source familiar with the matter has given this information.
