In the case of suspended Mayor of Jaipur Greater Municipal Corporation, Somya Gurjar, her SLP appeal is to be heard in the Supreme Court today. The hearing has been kept in the division bench of Justice Sanjay Kishan Kaul and Justice Hrishikesh Roy. Former Attorney General Mukul Rohatgi is appearing for Somya Gurjar on behalf of Advocate Ruchi Kohli.
During the last hearing, notices were issued to the Special Secretary and Deputy Director of the Department of the State Government, Local Bodies, Municipal Commissioner, and Acting Mayor Sheel Dhabai. The court is also looking at the whose reply. In the appeal, the order of June 28 dismissing the petition of Somya Gurjar has been challenged by the Rajasthan High Court. On behalf of the Municipal Commissioner, Somya Gurjar has been accused of speaking in a loud voice.
Somya's lawyer has said not to consider it as misbehavior. On this ground, the suspension is upheld. Along with this, arguments have been made to remove Somya Gurjar from the post of mayor due to political malice. The constitutionality of the provision of Section 39 of the Rajasthan Municipality Act regarding suspension alleging such misbehavior has also been challenged.
Senior Advocate Manish Singhvi is appearing for the State Government as Additional Advocate General. Those who have spoken of not taking action on behalf of the government on the basis of political malice. Because the OBC woman councilor of BJP has been made the caretaker mayor by the state government. Along with this, information has also been given about the arrest of Somya Gurjar's husband on corruption charges. Can Somya Gurjar be given interim relief?
