AAP Rajya Sabha MP Swati Maliwal's alleged assailant, Delhi Chief Minister Arvind Kejriwal's associate Bibhav Kumar, has had his judicial custody extended until June 22.
He is accused of brutally assaulting Swati Maliwal at Kejriwal's residence on May 13. Following the incident, Delhi Police arrested him.
Bibhav Kumar appeared via video conferencing before the Duty Metropolitan Magistrate, where the court decided to extend his judicial custody.
The court directed Delhi Police to present him in court on June 22. Previously, on Friday, the court had extended his custody for one day due to the absence of the IO.
He was initially arrested on May 18. After his arrest, the magistrate remanded him to five days of police custody on the same day. Subsequently, on May 24, he was placed under four days of judicial custody, followed by another three days of police custody.
An FIR was filed against him on May 16 under various sections of the IPC, including serious allegations.
The Delhi High Court has issued a notice to the Delhi Police on Bibhav Kumar's bail plea on June 14. Kumar has challenged the Trial Court's order denying him bail, claiming he has already suffered unlawful detention. He has been in custody for more than 25 days.
In his bail plea, Kumar alleges that the injuries reported by Swati Maliwal were falsely proven through an MLC report, which does not substantiate her statement.
He accuses her of misuse of criminal machinery and fraudulent investigation. Both Kumar and Maliwal have filed complaints against each other.
Kumar's plea states that Maliwal's influential status as a Rajya Sabha MP has influenced the investigation into her allegations against him, which remains unexamined. During Maliwal's presence in CCTV footage, Kumar claims he was threatened throughout.
