HC Instructs Delhi Government to Take Action Under Law

The petition filed in the Delhi High Court against the Delhi government's non-sanction of prosecution in the JNU sedition case was heard on Wednesday. The High Court has directed the Delhi government to take action under the law on a plea seeking sanction for a sedition case against former JNUSU president Kanhaiya Kumar. The court has also disposed of the petition of former BJP MLA Nand Kishore Garg with this order.

The petitioner, former BJP MLA Nand Kishore Garg, had alleged that the Delhi government was deliberately postponing the case. Let us tell you that during the demonstration held on 9 February 2016 in JNU campus, some students raised slogans supporting the attack on Parliament House, Afzal Guru and Bharat Tere Chote Hoga.

The petitioner also said that the Patiala House Court has given instructions to the Delhi government several times regarding grant of sanction, but still not allowed to prosecute. Nandkishore Garg said that it is not the job of the Chief Minister to sit on the file of a case. He has also filed a charge sheet in the Delhi Police case, yet why the Delhi government is not approving the prosecution and what is the reason behind it.

The petitioner has sought a direction from the High Court to the Delhi government to grant sanction for prosecution. On January 14, 2019, the Delhi Police filed a 1200-page chargesheet in the court. In this, Kanhaiya Kumar, former president of JNU Students Union, Umar Khalid, member of Democratic Student Union and Anirban Bhattacharya, a researcher of history, were made the main accused.

At the same time, seven other accused are Aqib Hussain, Mujib Hussain, Munib Hussain, Utar Gul, Rais Rasool, Basrat Ali and Khalid Bashir Bhat. Apart from this, 36 students, including Rama Naga, Ashutosh, Shaila Rashid, D Raja's daughter Aparajita Raja, Rubaina Saifi, Samar Khan have been placed in the suspects in column 12 of the chargesheet.
