Will the Workers get 54 days of Lockdown Pay? SC will Pronounce its Decision on June 12

The Supreme Court has reserved order in the matter of giving full salary to the employees during the lockdown period. On June 12, a court order will come on this issue. Industries have challenged the order of March 29 by the Union Home Ministry, which said that the entire salary during the lockdown would have to be paid to the employer.

During today's hearing, the central government said that it was necessary to issue an order giving full wages to the workers. The workers are economically in the lower state of the society. It was taken care of without any difficulty in getting money without industrial activity. Now activities have been allowed. That order has been withdrawn from 17 May.

Industries were not satisfied with the government's plea. Expressed inability to pay the full 54 days of pay between March 29 and May 17. Industries argued that the government should help the them. Significantly, in the earlier hearing, the Supreme Court also questioned that during which there was no production in the industries, will the government help the industries in paying the salary for that period.

A 3-judge bench headed by Justice Ashok Bhushan also asked today, 'Under the Industrial Dispute Act, industries can be asked to pay 50 per cent salary to employees in case of a dispute. You asked to give 100 percent salary. Do you have the right to do so? "

The Center had taken a tough stand in the affidavit filed in the court, saying that it should look at the edit report of the industries which are reluctant to pay the full salary. However, on behalf of the court, on behalf of the government, Attorney General KK Venugopal said, "If the industry and the workers can come to an agreement on the payment of the money, then the government will not object to it."

Justice Sanjay Kishan Kaul, a member of the Bench, said, "On one hand you are talking about getting all the money to the workers, on the other hand they are talking about a mutual agreement between the workers and the Industry. Well, it is necessary that economic activities should be fully started. But what will be the role of the government in this? It should do something to balance the two sides.

Lawyers for the hearing industries gave several arguments. They said that the government had given this order in the name of disaster relief. But they did not understand that his order was in itself a disaster for industries. Amplai State Insurance means 80 to 90 thousand crore rupees in the account of employee state insurance. If the government wanted to spend 30 thousand crore rupees, it could have given the salary of this period to the employees of the whole country. "

When the court sought a response from the Attorney General on this aspect, he said, "The money deposited in the account of the employee state insurance cannot be transferred anywhere else. In special circumstances, if an employee wishes, they can take money from it." In today's hearing, many trade unions also submitted their arguments. They said that the government and industry cannot break away from their responsibility. It should be ensured that the laborers can get all their money.

The court heard all the sides in detail for about one and a half hours. After that the order was reserved. The court order will decide whether the laborers will get full salary for a period of 54 days? If yes, what share will the government give?
