The Supreme Court has Refused to the Ban Reservation of General Category Poor

The Supreme Court has refused to ban the reservation given to the general category poor. However, the Supreme Court has agreed to hear the matter and issued a notice to the Central Government seeking the response.

The Supreme Court has refused to ban the poor sections of government jobs and the law giving reservation in educational institutions. In view of the petitions of the reservation being unconstitutional, the court has issued a notice to the Central Government seeking a response. Chief Justice Ranjan Gogoi said that we will review this issue.

The legality of the constitutional amendment has been challenged to provide a 10% reservation to the general category people in jobs and educational institutions on an economic basis in the court. These petitions have been filed by many organizations and people including Youth for Equality.

In the petitions, the validity of the Constitution Amendment (103th Amendment) Act, 2019 has been challenged, which both the Houses of Parliament had passed as the 124th Constitution Amendment Bill, 2019. The addition of Article 15 (6) and 16 (6) in the petitions has been referred to the changes in the basic structure of the Constitution
