The Supreme Court on Sunday heard a petition filed by the Shiv Sena-Congress-NCP challenging the oath-taking of Devendra Fandavis in Maharashtra. The next hearing will be at 10–30 am Monday. The Supreme Court has issued notices to the Central Government, Government of Maharashtra, Devendra Fadnavis and Ajit Pawar. The court asked Solicitor General Tushar Mehta to present the Governor's letter in the court on Monday in which he had invited the removal of President's rule and Devendra Fadnavis to form the government. The court turned down Mehta's request in which he sought a 2-day extension to present the letters of Governor Bhagat Singh Koshyari to the court.

Shiv Sena-NCP-Congress claim, they have majority

The Shiv Sena-NCP-Congress told the Supreme Court that they had a majority in the Maharashtra Legislative Assembly and if Devendra Fadnavis had a majority, they should prove their strength in the House. The three parties also said that it was a "betrayal and its assassination" with democracy that even when 41 NCP MLAs were not with BJP, it was approved to form the government.

Justice N. Senior advocate Kapil Sibal, appearing for the coalition before a bench of V. Ramanna, Justice Ashok Bhushan and Justice Sanjeev Khanna, said, "If Fadnavis has the strength, let him prove it on the floor of the House, otherwise We have the numbers to form a government in Maharashtra.
