When a boy's parents called his girlfriend a 'call girl', the girl committed suicide. A case has been registered against the boy and his parents for abetting the girl to suicide. After 15 years, when the decision came from the Supreme Court, the family was relieved. The Supreme Court said that by simply saying 'call girl', the accused cannot be punished by holding them responsible for suicide.
Justices Indu Malhotra and Justice R. Subhash Reddy said in his judgment that the reason for the suicide was the use of 'abusive' language, it cannot be assumed. The judges said that a word uttered in anger, the result of which has not been thought through, cannot be considered provocative.
Reference to old judgment-
The Supreme Court, in a similar earlier judgment, freed a man from the charge of abetting his wife to suicide. He told the wife to 'go and die' during the quarrel. The Supreme Court, citing the same old judgment in the latest case, said, "According to this judgment, we are of the view that such an allegation is not sufficient to carry forward the proceedings under Section 306/34 of the IPC. It is also clear from this allegation that none of the accused has ever instigated, seduced or lured the victim to suicide.
2004 case –
The Kolkata girl used to take English language tuition from the accused in the case. During this, the two became close to each other and decided to get married. However, when the girl went to the boy's house, the boy's angry parents heard him very well and even said 'call girl'. According to the complaint lodged by the girl's father, the girl was unhappy because her boyfriend did not object to her parents' behavior and words. The girl gave her life in this agony. The case is of the year 2004.
Case reached from trial court to high court-
The girl said in her two suicide notes that she was abused as a 'call girl' and that she loved, she did not even react to such a thing. After investigation, the police filed a charge sheet against the boy and his parents. The three accused opposed it in the trial court, but their plea was rejected. The Calcutta High Court then allowed him to file a petition in July. The state government moved the Supreme Court against this order of the High Court.
There was no option but to commit suicide, it cannot be said: SC
The Supreme Court upheld the High Court order after examining all the facts and evidence. He said, 'We also believe that this case is not about abetment of suicide. The accused cannot be held responsible for suicide and it cannot be said that after the behavior of the accused and their spoken words, the victim had no option but to commit suicide.
