Rajasthan: Filed FIR Against SI in illegal Recovery Case on Highway

The CJM court of the Jaipur Rajasthan has directed the SHO of Chandwaji police station to register an FIR against the accused SI Phoolchand for assaulting and demanding illegal recovery of one thousand rupees from the complainant by showing fear of over speeding on the highway. The court has asked the SHO to register the case and present the result of the investigation in the court. The court gave this order on the complaint of Advocate Devendra Chauhan.

An illegal demand of one thousand rupees from the complainant

It was said in the complaint that on April 5, 2021, when he was coming to Jaipur Rajasthan from NH-8. The policemen of rural traffic stopped him by telling his vehicle to be over speed. When the complainant said that his vehicle was not in over speed, then SI Phoolchand made an illegal demand of one thousand rupees from the complainant. When the complainant refused to pay the amount, the SI and two other constables pushed and beat up the complainant.

Register a case against the accused

He forcibly took out Rs 1500 from the pocket of the complainant and also took Rs 3500 kept on the car. Therefore, action should be taken by registering a case against the accused. The court while hearing the complaint directed the SHO to register the case.

The district and sessions court

Granting anticipatory bail in a matter pertaining to recovery of money in a dispute between a property owner and its manager. The district and sessions court here on Wednesday remarked. That it could not become an instrument in the hands of the police to allow them to act as "recovery agents". The court also wondered how a First Information Report was registered in a civil dispute.
