Nirbhaya Rape Case: No Mercy Petition For Convicts

The convicts of the 2012 Nirbhaya gangrape and murder case did not move the Supreme Court on Monday. The four convicts have refused to file mercy petitions for the reduction or death penalty. On the other hand, as per the pre-decided and well-thought-out special strategy, three of the four jailed convicts on Monday must reply to their notice to the Delhi government and the jail administration.

According to IANS, two convicts (Vinay Kumar Sharma and Akshay Kumar Singh) lodged in Tihar Jail and Dr Ajay Prakash Singh, counsel for Pawan Kumar Gupta lodged in Mandoli Jail, Delhi, confirmed this. The Tihar administration had warned the culprits on October 29 that they had only seven days left for the mercy petition. If they wish, he can also use the only legal right left to them for pardon by filing a mercy petition in front of the President within these seven days.

After receiving the notice, Nirbhaya's killer Vinay Kumar Sharma, lodged in Tihar Jail No. 2, Akshay Kumar Singh, who was lodged in Jail No. 4, and Pawan Kumar Gupta, jailed at No. 14 in Mandoli, were blown away. After Friday afternoon, the lawyers of the three convicts went to the jails with their clients for several hours of intense conversation. It was decided only after that special meeting that three of the four (the fourth accused Mukesh's strategy is yet to be revealed) would move the Supreme Court against the notices from the convict jail and not file mercy petition before the President.

Out of these three (Vinay Sharma, Akshay, Pawan), Akshay was expected to file a review petition in the Supreme Court. While the rest of the two convicts, Vinay Kumar Sharma and Pawan Kumar Gupta, the curative petition was coming out in the Supreme Court. But the lawyers of the three convicted convicts suddenly went to Tihar Jail and Mandoli Jail on Monday. Dr. Ajay Prakash Singh, counsel for Akshay Kumar Singh and Vinay Kumar Sharma said, 'Law is same for all. On October 29, the jail administration and the Delhi government gave seven days notice to the President to send a mercy petition, which was a mockery of the law, when our clients were scheduled to have several days of holiday together.

He further said, 'The case regarding the age of my client Pawan Kumar Gupta is pending in the High Court. While we still have the right to file petitions regarding Vinay and Akshay. In such a situation, what law is there to issue a notice directly to the perpetrators in such a short time?"
