The four convicts of the Nirbhaya gang rape case of 16 December 2012 now have the option of sending mercy petitions only to the President, which they have to send within seven days of receiving the notice. Tihar jail authorities have told the convicts that they have used all the legal remedies and now they have the option of only granting mercy petition to the President against the execution of the sentence. The jail superintendent gave this information in a notice issued on October 29 to the four convicts of the case.

The notice states, 'It is informed that if you have not yet filed a mercy petition and if you want to file a mercy petition with the President against the death penalty in your case, you can get this notice. Can do this within seven days. Failing this, it will be presumed that you do not want to file a mercy petition in your case and the jail administration will initiate further necessary legal proceedings as per law.

Tihar Jail Director General Sandeep Goyal said that they have been issued notice and if they do not file mercy petition then inform the lower court and it will decide on further action. Three convicts in the case are imprisoned in Tihar and one is kept in Mandoli jail. Sources said that if the mercy petition is not filed, the jail authorities will approach the court, which will issue a warrant for capital punishment.

Meanwhile, Nirbhaya's mother Asha Devi welcomed the Tihar Jail administration's move, saying, 'It should have happened long ago. The Supreme Court heard the judgment in 2017 itself. I have been struggling for seven years, but they have not yet been hanged. The jail administration has taken the right step.

It is noteworthy that six people were gang-raped in a moving bus in Delhi on the night of 16 December along with a 23-year-old student. Apart from the rape, She was assaulted and later thrown on the middle of road. The victim died during treatment on 29 December 2012 at a hospital in Singapore. Ram Singh, one of the six arrested for gang rape, hanged himself in jail , while the minor accused was sentenced to three years in prison in a juvenile home, who now has been released.

At the same time, the Supreme Court on July 9 last year dismissed the petitions of the three convicts Mukesh (31), Pawan Gupta (24) and Vinay Sharma (25). He had requested to reconsider the 2017 Delhi High Court verdict which upheld the death sentence awarded to him in the lower court. At the same time, Akshay Kumar Singh (33), the fourth convict facing death sentence, had not filed a Supreme Court reconsideration petition.
