The government and the Lokayukta are vis-a-vis the investigation of corruption cases.  For the second consecutive day, Lokayukta Justice Dhruv Narayan Upadhyay appeared angry at the government investigative agency.  He said that corruption is prevalent in almost all departments.  Cabinet surveillance and ACB action is limited to small fish, but the officers, who are class-two officers at the center of this corruption are now saved.

Not only this, the Anti-Corruption Bureau (ACB) somehow misinterprets the authority of the Lokayukta through reports and harmony also tries to do so. The Lokayukta said that the Lokayukta has its own investigating agency in Bihar, Madhya Pradesh and Karnataka.  This has not happened yet in Jharkhand.  Now the Lokayukta has decided that with the help of a private agency, they will also investigate corruption cases.

The Cabinet will seek Permission from the Secretariat

At present, the Anti-Corruption Bureau (ACB), the investigating agency of the Government is operating as per the resolution (rules) dated 07 August 2015 of the Cabinet Secretariat and Monitoring Department.  Section-20 of this rule has been interpreted and ordered that the ACB will first conduct a confidential investigation of the Lokayukta order rather than accepting it directly.  Only then will the cabinet seek permission from the Cabinet Secretariat and Monitoring Department for PE.

Giving examples, Lokayukta Justice Upadhyay said that a case of irrelevant assets was incisive against a public servant during the time of the previous Lokayukta.  In this case, the ACB has been ordered to investigate the disproportionate assets case three times.  Each time the report given by the ACB, the total assets of the accused public servant was stated to be 40 lakh rupees.
