Swamy's case was considered by a court consisting of Chief Justice DN Patel and Justice Jyoti Singh. Subramanian Swamy stated that he is not opposed to disinvestment during this time. I support disinvestment, he said. I've always been a proponent of free markets. In the entire process, I have simply raised the subject of impropriety. During the hearing, Subramanian Swamy stated that a thorough discussion of Air India's disinvestment process is required. This is affected the entire country.

Swamy has asked the authorities to stop taking any further action, decision, approval, or license in respect to the current Air India disinvestment process. Subramanian Swamy has also requested a CBI investigation into the officers' function and conduct, as well as a full report before the court, in the plea filed through counsel Satya Sabarwal.
On October 25 of last year, the government approved the acquisition of Air India by accepting an offer from a Tata Sons subsidiary. Along with Air India, the company would sell 100 percent ownership in its low-cost carrier, Air India Express. In addition, the Tata Group would receive a 50% share in its ground handling company, AISATS.
