Sharad Bahadur Yadav has alleged in his petition that his nomination papers were incorrectly rejected by the returning officer of Varanasi, as a result of which he could not contest the Lok Sabha elections, which is his constitutional right. He has requested Prime Minister Narendra Modi from Varanasi to declare the parliamentary election as invalid. Yadav has argued that since Modi has not given any details about his family in the nomination papers, his nomination papers should also be canceled which was not done. After hearing the plea of ​​the petitioner's lawyer that his client was not given an opportunity to reject his nomination before dismissing the nomination, Justice MK Gupta issued this notice.

It is notable that many petitions have been filed in the Allahabad High Court, challenging the elections of several elected MPs. Aamam Khan from Rampur parliamentary constituency, Sangit Mitra Maurya from Badayu, Anupriya Patel from Mirzapur, Ramesh Chand from Bhadohi and Bhola Nath from Fish city have been challenged in the Allahabad High Court and these petitions are pending.
