After the implementation of the New Motor Vehicle Act, Gujarat has become the first state to provide relief to the drivers of heavy fines with the implementation of the new law. Gujarat has reduced the amount of the penalty for the new Motor Vehicle Act by 50 percent. After this, nine other states can also provide huge relief to the drivers from heavy fines along the same lines. Six of these states are where the new Motor Vehicle Act has not been implemented. Apart from this, there are three Union Territories where there is a lot of confusion about the new Motor Vehicles Act.
The new Motor Vehicle Act has been implemented by the central government from September 1 across the country. The revised Motor Vehicle Act prepared by the Central Government provides for heavy fines. As before, the amended Motor Vehicle Act provides for several times more fines. Along with the implementation of the new Motor Vehicle Act, the Central Government has given exemption to the transport department of the states that they can decide on the provisions of the amendment or not to implement the amended Motor Vehicle Act on the recommendation of the state government.
These nine states did not implement the new MV Act
Six states have not implemented the revised Motor Vehicle Act implemented across the country from September 1. These states have their own logic behind this. The most common argument is against the heavy fines of the new Motor Vehicle Act. This means that old drivers are still being charged for violating traffic rules from the drivers of these six states. These six states are Madhya Pradesh, Chhattisgarh, West Bengal, Rajasthan, Punjab and Himachal Pradesh. Apart from this, there is a lot of tension in the three Union Territories of Jammu and Kashmir, Ladakh and Delhi regarding the new Motor Vehicle Act.
The amount of penalty can be reduced on the lines of Gujarat
Six states, which have not yet implemented the new Motor Vehicle Act, argue that the amount of fine is too much. All these states including Madhya Pradesh, Rajasthan and Chhattisgarh have said that they will implement this law only after studying the effects of the new Motor Vehicle Act in other states. In such a situation, it is very possible that these states can also implement the new Motor Vehicle Act on their own lines with the same penalty as Gujarat. It is known that all the political parties are continuously objecting to the heavy penalty of the new Motor Vehicle Act. If these nine states reduced the amount of the penalty, the pressure on other states to reduce the amount of the penalty will increase.
These huge invoices are in discussion
With the heavy fines, many shocking reports of the Motor Vehicle Act implemented in other states are continuously coming out. The first news came from a scooter rider in Gurgaon cutting a challan of Rs 23,000. After this, after the challan of Rs 25,000 in Delhi, the young man had set him on fire. Apart from this, reports of invoicing of Rs 24000 and Rs 35000 for bikes in NCR, Rs 1,16,000 in Rewari, Rs 59000 for a tractor in Gurgaon and Rs 1,41,000 for truckers in Delhi have left the drivers in a panic.
Jammu and Kashmir and Ladakh will be separated next month
Jammu and Kashmir and Ladakh are currently the same state. With the abolition of Articles 370 and 35A from Jammu and Kashmir, the Central Government has announced to make the two separate Union Territories. Notification of both the new union territories will be issued next month. With this, these different union territories will come into existence.
Why Delhi and J&K Police are confused
Delhi and Jammu and Kashmir Police are in confusion over the new Motor Vehicle Act. Notification of the implementation of the new Motor Vehicle Act has not been issued by the state governments here so far. The police here is under the central government. Hence, police has started deducting challans of drivers with heavy fines under the new Motor Vehicle Act. However, at both the places the police is not charging heavy on-spot fine of the challan being deducted under the new Motor Vehicle Act. The drivers are being asked to go to court and pay the challan. This is because the notification to implement the new Motor Vehicle Act was to be issued to the states. The law cannot apply in the event of states not issuing notifications. So the police is cutting the challan of heavy fine, but it is not able to recover the fine.
