Businessman Raj Kundra, husband of actress Shilpa Shetty, has applied for anticipatory bail in the Bombay High Court in the pornography case. The names of Poonam Pandey and Sherlyn Chopra are also linked in this case. The court last week adjourned the hearing of the case till Monday. Now, Advocate Prashant Patil and Advocate Swapnil Ambure, Head of Kundra's Legal Team, say that in the present situation. Neither Section 67 nor Section 67(A) can be made out against the applicant or any co-accused.
Kundra's advocate Prashant Patil said in a statement, "The prosecution wishes to argue that the videos of Sherlyn Chopra and Poonam Pandey are the subject of crime. It is a matter of record that Kundra had no role in producing or distributing these videos." In fact, both Sherlyn Chopra and Poonam Pandey have said that they themselves made such videos and it was done by them for commercial gain."
Prashant Patil further said on the matter, "We have submitted a judgment and a brief note, which shows how the said content and videos do not attract 67A of the IT Act. Prashant Patil has also told the court in the note That Kundra is not in any way associated with the content creation, publication and telecast of the above videos. The videos in question may be erotic but do not show any physical sexual activity. These are shot by the actors. to which the artists have agreed."
Additional documents submitted by the lawyers to the court said that Kundra, who is a UK citizen, is not named in the FIR and has been dragged into the case because of the statements of other co-accused. Kundra, on the other hand, says that he was a director in Armsprime Pvt Ltd. The purported video of Sherlyn Chopra was uploaded after Kundra exited the company. Addressing the investigation related to the app 'Hotshots', the lawyers said, "No content appearing on 'Hotshots' was created or uploaded during the period when Raj was associated with it."
The Bombay High Court had accepted the anticipatory bail applications of Sherlyn and Poonam in the porn case. After hearing their plea, the court announced that no coercive action would be taken against the two till 20 September 2021. Both Sherlyn and Poonam had said that Kundra forced them to shoot A-rated films. The hearing on Kundra's anticipatory bail, in this case, will be held on November 25.
Raj Kundra was in jail for 2 months in a porn film making the case. Mumbai Crime Branch has filed a 1,500-page charge sheet against Raj Kundra in court. However, Gehna Vashisht had claimed that Sherlyn had drawn Raj into the bold content industry. Sherlyn is throwing mud at Raj only to grab attention. Gehna says that now Sherlyn is targeting Shilpa Shetty.
