Petition filed against Dushyant Chautala for Swearing-in as Deputy CM of Haryana

In the new BJP-JJP Government of Haryana, a big question has been raised about Dushyant Chautala taking Oath for the post of Deputy CM. It has been challenged in the High Court stating that the leader of Jananayak Janata Party(JJP), Dushyant Chautala is unconstitutional.

The petition filed in this regard in the Punjab and Haryana High Court stated that there is no provision for the post of Deputy Chief Minister in the constitution. By the way, it is believed that this petition is not going to have much effect. When Devi Lal Chaudhary became the Deputy Prime Minister of the country, his appointment was challenged in the Supreme Court. At that time, the Supreme Court had refused to cancel the appointment and said that if there is no additional benefit to the Deputy Prime Minister or Deputy Chief Minister, then there is no objection in this.

In such a situation, it is believed that on the basis of this decision of the Supreme Court, Haryana Deputy Chief Minister Dushyant Chautala is not yet a political threat. Experts say that the petition filed in the High Court on Tuesday does not look strong on the basis of legal facts. Deputy CMs have been created in several states including Andhra Pradesh, Rajasthan, Delhi, Maharashtra, Punjab and Uttar Pradesh, but the judiciary has not removed any deputy CMs in any state yet.

The PIL filed by High Court lawyer Jagmohan Bhatti alleged that it was against the rules to appoint Dushyant Chautala as the Deputy Chief Minister of Haryana. According to the petition, the Governor's swearing of Dushyant Chautala as Deputy Chief Minister is a violation of Article 164 of the Constitution. The petition said that there is no provision of Deputy Chief Minister anywhere in the Constitution, then how the Governor administered the oath of Deputy Chief Minister.

The petition said that as long as this law is under consideration, all the facilities that Dushyant gets as Deputy Chief Minister should be banned. Kaabil-e-Zeekhan states that there is no provision to provide additional facilities to the Deputy Chief Minister in any state, on the basis of which there is no threat to the post of Deputy Chief Minister of Dushyant Chautala.
