A petition was filed against Rahul Gandhi by the supreme court after his Rafale remark in a response to which Rahul Gandhi said that the remark was made in the heat of political campaigns and was  being misused by the opponent party.

He quoted saying that "My statement was made in the heat of political campaigning my opponents has wrongly projected that I have deliberately and intentionally suggested that SC had said 'Chowkidar chor hai'. Nothing could be farther from my mind".

BJP leader Meenakshi Negi, a sitting Lok Sabha MP from New Delhi Constituency  went to the apex court alleging that Rahul Gandhi attributed his personal remark to the top court and tried to create a prejudice. After which the top court gave a categorical clarification  that in its Rafale judgment that there was no occasion to make a mention of alleged contemptuous observation that "chowkidar Narendra Modi chor hai" as has been attributed by Rahul Gandhi.

The supreme court had directed the Congress chief to give an explanation for his comment.

In his affidavit, Rahul said his statement against Modi was made during political campaigning when he had not seen or read the SC order April 10, adding there was no slightest intention to insinuate anything regarding the court proceedings.
