Delhi Court Acquitted a Husband on the Charges of Raping his wife

A Delhi court acquitted a man of rape charges, saying that on the day the accused forcibly had sexual relations, the complainant was his wife. Additional Sessions Judge Umed Singh Grewal said that the woman accused the person that she raped her on July 5, 2016, but it could not be considered a rape case as she was 'the wife of the accused.'

The court acquitted the person, saying, 'It is clear that the complainant had married the accused on or before November 2, 2015. According to her own plea, the accused raped her on July 5, 2016, but she was his wife that day.' The complainant resided in Punjab with the accused. During this time he came to know that the person has been convicted in the case of theft and has gone to jail. After this she came to Delhi without informing him.

The man reached Delhi and assured the woman that he would now improve. After this the couple started living together. After this, the accused stole two lakh rupees of the woman. The wife then refused to be with him. On the complaint of the woman, the police arrested the accused. The complainant alleged that despite this, the accused continued to come to his house and repeatedly forcibly had sexual relations. The court said, "When the accused forcibly had physical relations with the complainant, she was his wife at the time and hence rape case does not arise".
