Center or State? Know Whose Account Holds Traffic Challan

Traffic regulations have become stricter after the new Motor Vehicle Act came into force. People who break the new rules of traffic are now paying heavier fines than before.
Center or State? Know Whose Account Holds Traffic Challan

The New Motor Vehicle Act is in force in most states of the country from September 1. After its implementation, people have to pay heavy fines for breaking the traffic rules. Recently, in the country's capital Delhi, a truck challan worth more than Rs 2 lakh has been cut. This is the most expensive invoice ever. This challan was also submitted to the court. But the question is that the challans which are being deducted in different states of the country are going to whose account. Let's know the answer to this question …

In whose account does the invoice amount go?
In a state, the amount received from the challan deducted by the traffic police goes to the state government account. For example, if the challan of your car is cut in Patna, then the amount received from it will go to the account of the Ministry of Transport, Government of Bihar. At the same time, the amount of challan in the Union Territories goes to the central government account.

However, in case of Delhi only, there is a slight change in the rule regarding challan. Actually, the traffic police of Delhi comes under the Central Government while the State Transport Authority is responsible for the Delhi Government. Both the Traffic Police and the State Transport Authority have the right to deduct challans in Delhi.

If the matter reaches to the court…
Many times it happens that the challan amount is deposited in the court, what happens in such a situation? When we asked this question to Dhirendra Kumar, senior advocate of Patna High Court, he said, "In such a situation, the amount of challan also goes to the state government. However, this scale changes in other Union Territories including Delhi. "According to Dhirendra Kumar, if the traffic police in Delhi deducts the challan, the amount will go to the central government account. Similarly, if the State Transport Authority has deducted the challan, then this amount will go to the Delhi government account because the state transport department comes under the Delhi government.

If Challan Fined on National Highway…
If the challan is deducted on the National Highway, then in such a situation the amount of the penalty is divided between the Central and State Government. At the same time, the amount of challan deducted on the state highway goes to the state government account. At the same time, once again in Delhi's case, it is seen whether the traffic police cutting the challan is or the State Transport Authority. Madhav Pai, director of the World Resource Institute (WRI), who suggested to the state government about the transport system of Delhi, said that many times challan money is collected by making it a safety fund.

3 big Challans so far
– On September 12, the biggest challan fined on a truck in Delhi. The penalty amount for this truck's challan was Rs 2,00, 500. This challan was cut by Delhi Traffic Police at Mukarba Chowk. The penalty amount of this challan deducted in overloading was paid by the truck owner in court.

– On 5 September last, a truck with Rajasthan number was fined Rs 1,41,700 in Delhi itself. Its fine amount was deposited in Rohini's traffic court on September 9 after four days. This challan was also done for overloading.

On September 3, a truck driver was fined Rs 86,500 in Odisha. The Sambalpur Regional Transport Office (RTO) imposed this fine. However, on September 6, after filling the settlement amount of 70 thousand rupees, the truck driver was allowed to take the truck.

Not every state has the same status
The new traffic rules and the amount of challan should be same in every state, it is not necessary. If the state wishes, it can give relief in the amount of this rules or challan. Under this, states like Gujarat and Uttarakhand have given relief to the people. At the same time, states also have the right to reject this new rule. This is the reason that new rules of traffic are not applicable in many big states including West Bengal, Maharashtra.
