Apartment Honorship Act to be Implemented in Rajasthan this Year

After waiting for almost a decade and a half in Rajasthan, the Apartment Honorship Act will come into force by the end of this year. With the enactment of this act, not only the apartment owner will get the right to own the land, but also get many other rights. The government will prepare and issue the rules of the Act by November 15 and after completing the process of taking objections and suggestions from the public, this act will be implemented by the end of this year.

Flats and Apartments are now being built in multi-storeyed buildings in Udaipur, Kota, Jodhpur and many big cities of the state including Jaipur in Rajasthan. Despite this, the Apartment Honorship Act was not yet in force in Rajasthan. Although its exercise had been going on for nearly 15 years and the bill had been passed by the Rajasthan Legislative Assembly thrice, but due to various reasons the rules were never made, instead it was repeatedly amended and brought to the Assembly. It was last amended in April 2018 at the time of the previous government. President Ram Nath Kovind approved it on July 3 this year and sent it. Despite being three months, the rules of this act were not being made. It was not possible to implement it as there were no rules.

Now recently, Bhaskar A. Sawant, Principal Secretary, Urban Development Department, has held a meeting in this regard and has fixed the time limit for implementing this Act. Accordingly, the draft rules under this bill will be prepared by the Chief Municipal Employer Office by 10 November. The draft of the rules will be released on the website of the Urban Development Department by 15 November. After this, objection or suggestion will be sought from the general public in ten days. The Act will be implemented with the rules by the first week of December.

After the enactment of this act in Rajasthan, the owner of the land on which apartments are built will also get ownership. According to the number of apartments built on the land, the right to land will be given to him. Under the Act, the builder has to issue all the leases of the land in favor of the apartment buyer in order to give ownership of the land.

– Within six months of the allotment of the apartment, the builder must edit the deed of apartment in favor of the buyer.

– A residential development committee will be formed of people living in apartments.

– The concerned builder or developer will provide all information of the building map, wiring and plumbing etc. to that committee.
